He obtained his B.S. degree from Clark College in Atlanta, Georgia in 1971, and his J.D. degree from Harvard Law School in 1974. He went on to graduate from the Judge Advocate General's School in Charlottesville, Virginia in 1975 and from the Howard University School of Divinity in 1985. Spencer served under civil rights activist Marian Wright Edelman at the Washington Research Project in 1967. He worked for the Atlanta Legal Aid Society, the U.S. Army Judge Advocate General's Corps, and the U.S. Attorney's Office, before being appointed the first African American federal judge in the Eastern District of Virginia in 1986. He served as the district's chief justice, starting in 2004, and became senior judge in 2014. Spencer also served as associate pastor of 3rd Union Baptist Church in King William, Virginia.;
